Eligibility

Please read the rules in their entirety. Entries not complying with the rules will be disqualified.
Contest open only to individual legal residents of the 50 United States (excluding Arizona) and Washington DC, 18 years of age or older, and at least the age of majority in entrant's jurisdiction, at the time of entry. Sponsor, its affiliates, agencies, professional advisors, and contest judges, as well as their employees, owners, and immediate family members are excluded.
Entry
No entry fee is required.
Entries must be submitted via the Internet using the web page form found at http://www.smileonmymac.com/contest. Information on the form must be accurate and complete.
All entries must be received between 12:00:01 AM Pacific Standard Time on February 18, 2009 and 11:59:59 PM Pacific Standard Time on March 15, 2009.
Limit one entry per person.
Entrant must be the sole author of the contest entry answer.
Sponsor is not responsible for incomplete, lost, or late entries, nor for any disruption, failure or corruption of any communication, computer file, network, software, or other systems used in the creation, submission, or judging of an entry, or in communications with entrants, nor for misdirected or misclassified communications, including email misclassified as "junk mail". Entries will not be returned and may be kept or deleted at Sponsor's discretion; entrants are advised to keep a backup copy.
Judging
Eligible entries will be judged by a qualified judge or panel of judges selected by Sponsor. The determination of the judge(s) is final.
Winners will be determined from qualifying entries and judged based on the following criteria:
Creativity: 100%
Entries tied after the first round of judging will be subjected to subsequent rounds of judging based on the same criteria until all ties are resolved.
Judging will be completed within three weeks of the end of the contest entry period, at which time the winners will be contacted and the results of the contest will be publicly announced. All announced winners remain subject to verification and disqualification and must comply with the rules, including providing signed releases and grants of rights and other documents as specified in these rules.
Prizes
Five (5) Grand Prizes: 2GB iPod Shuffle, retail value of $69.00 each.
Total retail value of all prize packages: $345.00
General Agreement
Submitting an entry automatically constitutes the entrant's acceptance of all conditions set forth in the rules.
By submitting a contest entry, entrants irrevocably agree to grant, and actually grant, Sponsor a non-exclusive, worldwide, perpetual, unlimited, transferable, assignable, sublicensable, royalty-free right and license to reproduce, create derivative works, modify, translate, adapt, disply, publish, distribute and otherwise commercially exploit the entry in any manner and context in all media and by all means now known or future discovered, without further compensation; and agree not to file, authorize, support or maintain any lawsuit, claim, or legal action against Sponsor its affiliates, agents, representatives, or any other persons, on the grounds that any use of the entry or derivative works infringe any of entrant's rights as creator or owner of the entry, including without limitation any copyright, trademark rights, and moral rights or droit moral.
Winners will be notified by email and required to sign and return within 10 days of the email an affidavit of eligibility and release of liability, and a written grant of rights as specified in these rules, in a form of Sponsor's choosing. Winners further agree to execute from time to time any additional documents deemed necessary by Sponsor to further protect or perfect the rights granted to Sponsor by these rules.
Winners also grant Sponsor the right to use the winning entries, together with their names, likenesses and biographical information, in products, advertising and publicity without compensation. Failure to comply with all these conditions may result in prize forfeiture. Prizes will be awarded within 4-8 weeks of receipt of the signed affidavit and grant.
If unable to contact or locate a given winner, an alternative winner may be chosen from eligible entries by the judges based on the same judging criteria.
By entering, you agree to release Sponsor and its associates, judges, professional advisors, and suppliers, their employees and representatives from all claims and liabilities in connection with this Contest or with the awarding or use of any of the prizes.
Limit one prize per person, family or household. Winners may not transfer prize rights nor obtain substitutions or cash redemption, but Sponsor reserves the right to substitute a prize of equal or greater value if a prize becomes unavailable for any reason. All taxes on prizes and incidental expenses not specified in the above prize descriptions are solely the responsibility of winners.
Sponsor reserves the right to disqualify anyone who, in their opinion, has tampered with or disrupted the entry process or operation of this contest or violated the rules. If the contest cannot be run as planned for any reason, including technical problems, Sponsor reserve the right to cancel, curtail, modify or suspend the contest. In the event the contest is terminated early, winners will be selected from all eligible entries received at the time of termination.
To the extent permitted by law, these terms shall be interpreted, and this contest shall be conducted, in accordance with Oregon law, without giving effect to choice of law provisions. All disputes concerning these terms and this contest shall be settled by binding arbitration before a single arbitrator in Portland, Oregon, USA.
